The apprenticeship contract: definition and remuneration

The apprenticeship contract gives the person in training the status of apprentice employee of the company. It can be a CDL (limited-term contract) lasting between 6 months and 3 years, or even a CDI (permanent contract). In the case of a CDI, the apprentice must start with a trial period.

What does this type of contract look like?
The contract provides for a schedule of 35 hours per week, including the hours of theoretical courses provided by the training center. The expected remuneration mint database depends on the age of the apprentice, their year of training (first, second or third) and is calculated as a percentage of the minimum wage in force for the year concerned. For example, on August 1, 2022, the monthly gross basic minimum wage was 1,678.95 euros – or 20,147.40 euros per year. Apprentices aged 26 and over can receive 100% of this minimum wage, regardless of their year of training. On the other hand, apprentices aged 16 or 17 in the first year only receive 27% of the minimum wage, but this percentage increases to 55% in the 3rd year.

The age groups taken into account are: 16-17 years, 18-20 years, 21-25 years and 26 years and over. The salary in the first year of apprenticeship for these age groups is respectively: 27%, 43%, 53% and 100%.

While these salaries may seem low, various forms of assistance are in place. For example, apprentices under 21 receive an apprenticeship bonus of 335 euros. Apprentices under 30 can receive the mobili-jeune assistance (covering part of the rent), as well as the LocaPass or Visale guarantee to protect against unpaid rent. There is also an assistance of 500 euros to obtain a driving license, often required by many employers. Finally, the apprentice can also apply for personalized housing assistance (APL) from the Family Allowance Fund (CAF).

In addition, the apprentice is exempt from Income Tax (provided that his salary does not exceed the minimum wage), General Social Contribution (CSG) and Contribution for the Repayment of Social Debt (CRDS). No employee contribution is deducted from the portion of his gross salary equivalent to 79% of the minimum wage.

The apprentice benefits from the same right to leave as employees of his company, i.e. 5 weeks of vacation per year. Also provided for are maternity or paternity leave, leave in the event of a death in the family, civil partnership or marriage.

In the specific case of a liquidation of the company during the term of the contract, the liquidator will terminate the apprenticeship contract himself. The apprentice then legally benefits from compensation at least equal to the remuneration he had left to obtain until the end of the contract.
