As one of the first measures of his third term, President Luiz Inácio Lula da Silva revoked, on the day of his inauguration, the decrees of the previous administration that made it easier to access firearms. The review of gun control rules in Brazil was part of Lula's promises during his election campaign.
Decree No. 9,785, issued by former President Jair Bolsonaro in 2019, granted permission for collectors to acquire up to five firearms of each model, while hunters could own up to 30. Now, with the new benin mobile database decision, possession of up to three registered firearms per category will be permitted.
Furthermore, the decree, made by Lula, also restricts the purchase of new equipment and ammunition for hunters, collectors and shooters, and cancels new registrations of shooting schools until the re-edition of the rules for gun control takes place.
The intention is to suspend the licenses until there is a new regulation for Law 10.826/03, on the Disarmament Statute. In the revocation document, the president has already instructed those responsible to address the issue. However, the expectation is that, until the new regulation is validated, the renewal of registrations and the acquisition of ammunition for restricted-use firearms will remain blocked.
Other activities, such as recreational shooting carried out by unregistered people who do not have a gun permit, will also only be permitted after the new regulations.
The determination also indicates that all weapons for permitted and restricted use registered after the former president's rules must be registered in the National Weapons System (Sinarm) within 60 days.
Regarding the permitted use of firearms, the issuance of a Firearm Registration Certificate will also be mandatory, and registration will only be granted to people who prove the following requirements: minimum age of 25; effective need; suitability and absence of a police investigation or criminal proceedings; technical capacity and psychological aptitude for handling a firearm; lawful occupation and a fixed residence.
